File 2005.04: Cherry v. Time Warner
Case Type: Personal Injury
Description:
A semi-truck struck low cable lines while workers were removing cables causing a pole to break, hitting and killing a KCPL worker.
Visualizations Produced:
Plaintiff's counsel argued that the semi-truck driver should have been more aware of the low cable lines and known that he could not clear them.
It was demonstrated that during the course of the day the semi-truck had traveled under the cable lines two other times without incident. However as more cable lines were removed from other sides of the pole, which was not properly secured, the weight of the remaining cable line caused the pole to bend, lowering the line and causing it to catch on the semi-truck as it passed under.
