Case Type: Highway Shoulder Accident
Description:
A case in which the driver of a van loses control on a highway, hurtling through a guardrail and landing upside down in a small pond. The plaintiff argued the van lost control because of tire scrubbing. (Tire scrubbing is a situation in which a car's tire falls off a steep road edge. When the driver sharply turns the steering wheel to force the car back on the road, the car can swerve as the tire pops over the edge of the pavement.) The defense argued that the driver fell asleep and ran completely off the road, subsequently over-steering as he pulled back on to the driving pavement.
